Terms of Service

Welcome to GlassJack. These Terms of Service ("Terms") govern your use of the GlassJack mobile application (the "App") operated by Nauta Ventures LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using GlassJack, you confirm that you:

• Are at least 17 years of age
• Have the legal capacity to enter into a binding agreement
• Are not barred from using the App under applicable law
• Will comply with these Terms and all applicable laws and regulations

2. Description of Service

GlassJack is an educational mobile application designed to help users learn and practice blackjack basic strategy. The App provides:

• Basic strategy training and practice tools
• Timed challenges and game modes (Blitz Mode, Daily Challenge)
• Progress tracking and performance analytics
• Strategy reference charts
• Leaderboards and achievements via Apple Game Center

Important: GlassJack is a training and educational tool only. The App simulates blackjack scenarios for learning purposes and does not involve real money gambling. No real money can be won or lost through the App.

3. Account and Game Center

The App integrates with Apple Game Center for leaderboards and achievements. By using Game Center features:

• You agree to Apple's Game Center terms and conditions
• Your Game Center display name and scores may be visible to other users
• You are responsible for maintaining the security of your Apple ID
• You agree not to manipulate scores or exploit bugs to gain unfair leaderboard positions

4. In-App Purchases and Subscriptions

4.1 Premium Features

GlassJack offers premium features through in-app purchases and subscriptions. By making a purchase, you agree to the following:

• All purchases are processed by Apple through the App Store
• Prices are displayed in your local currency and may vary by region
• Purchases are final and non-refundable except as required by law or Apple's refund policies
• You are responsible for any applicable taxes

4.2 Subscriptions

If you purchase a subscription:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

4.3 Refunds

All refund requests must be submitted directly to Apple. We do not have the ability to process refunds. To request a refund, visit Apple's Report a Problem page or contact Apple Support.

5. User Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems
• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on the App
• Use cheats, exploits, automation software, bots, hacks, or unauthorized third-party software
• Manipulate or falsify leaderboard scores or achievements
• Interfere with or disrupt the App or servers connected to the App
• Use the App to transmit any malware, viruses, or harmful code
• Impersonate any person or entity or misrepresent your affiliation

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to:

• Text, graphics, logos, and icons
• Software, code, and algorithms
• User interface design and layout
• Audio and visual elements
• Training methodologies and content

are owned by Nauta Ventures LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES OF NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY CONTENT

Educational Purpose Only: GlassJack is designed for educational and entertainment purposes. We do not guarantee that using the App will improve your performance in real casino blackjack or result in any financial gain. Gambling involves risk, and past training does not guarantee future results.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAUTA VENTURES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your use or inability to use the App
• Any damages resulting from unauthorized access to or alteration of your data
• Any gambling losses or financial decisions made based on skills learned through the App

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nauta Ventures LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, violation of these Terms, or violation of any rights of a third party.

10. Termination

We reserve the right to:

• Suspend or terminate your access to the App at any time, with or without cause
• Remove any content or disable any feature of the App
• Discontinue the App or any part thereof at any time

Upon termination, your right to use the App will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

11. Changes to Terms

We may modify these Terms at any time by posting the revised Terms on this page and updating the "Effective Date." Your continued use of the App after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. You agree to waive any right to a jury trial or to participate in a class action.

13. Apple App Store Terms

The following terms apply to your use of the App downloaded from the Apple App Store:

• These Terms are between you and Nauta Ventures LLC, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for any product warranties, whether express or implied
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them against you
• You must comply with any applicable third-party terms when using the App

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nauta Ventures LLC regarding the App and supersede all prior agreements and understandings, whether written or oral.
